These Terms & Conditions ("Terms") constitute a legally binding agreement between Peregrine Odyssey and every individual or entity ("Customer," "Participant," "User," or "you") who accesses, browses, creates an account on, makes an enquiry through, or books any service offered through www.peregrineodyssey.in ("Website").
These Terms govern your access to and use of the Website, including all expedition-related services, bookings, customer accounts, communications, digital content, and any other products or services offered by Peregrine Odyssey.
By accessing or using the Website, creating an account, submitting an enquiry, making a booking, or otherwise using any of our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, our Booking Policy, our Cancellation & Refund Policy, and any additional policies referenced herein.
If you do not agree with these Terms, you must immediately discontinue use of the Website and refrain from making any bookings or using our services.

2. DEFINITIONS
For the purposes of these Terms & Conditions, the following words shall have the meanings assigned below unless the context requires otherwise.
Account means the registered profile created by a User on the Website for accessing expedition bookings, managing reservations, and using customer services.
Booking means a reservation for an expedition or any other service offered by Peregrine Odyssey, whether made directly through the Website or through any officially authorised communication channel.
Booking Confirmation means the written confirmation issued by Peregrine Odyssey after successful verification of booking details and receipt of the applicable payment.
Customer, Participant, or User means any individual who visits the Website, creates an account, makes an enquiry, books an expedition, or otherwise uses any services provided by Peregrine Odyssey.
Expedition means any motorcycle tour, road trip, adventure experience, private expedition, group expedition, customised journey, or related travel experience organised or facilitated by Peregrine Odyssey.
Group Expedition means an expedition operated for multiple participants travelling together according to a predetermined itinerary.
Private Expedition means an expedition arranged exclusively for one individual or a private group in accordance with an agreed itinerary.
Road Captain means the individual appointed by Peregrine Odyssey to lead an expedition, coordinate the riding group, manage logistics, provide guidance, and promote safety throughout the journey.
Support Vehicle means any vehicle arranged by Peregrine Odyssey for logistical assistance, luggage transportation, emergency support, or mechanical assistance during an expedition.
Motorcycle Rental Partner means an independent third-party provider that supplies motorcycles for expeditions where rental motorcycles are offered.
Force Majeure Event means any circumstance beyond the reasonable control of Peregrine Odyssey, including but not limited to natural disasters, landslides, earthquakes, floods, cyclones, severe weather, pandemics, epidemics, war, civil unrest, terrorism, governmental actions, road closures, strikes, fuel shortages, or other unforeseen events affecting the safe operation of an expedition.
Website means www.peregrineodyssey.in, together with all associated webpages, mobile interfaces, booking portals, and digital services operated by Peregrine Odyssey.
Words importing the singular shall include the plural and vice versa where the context so permits. References to any gender include every gender.

3. ACCEPTANCE OF THESE TERMS
By accessing or using the Website, you expressly acknowledge and agree that these Terms constitute a legally binding agreement between you and Peregrine Odyssey.
Your continued use of the Website shall be deemed as your acceptance of these Terms, regardless of whether you have created an account or completed a booking.
If you make a booking on behalf of another individual, you represent and warrant that you have obtained the necessary authority to accept these Terms on behalf of all participants included within that booking. You further agree that you shall be responsible for ensuring that every participant is aware of and complies with these Terms.
Peregrine Odyssey reserves the right to refuse access to its Website or decline any booking where a person fails to comply with these Terms or where the Company reasonably believes that accepting such booking may compromise operational integrity, safety, or legal compliance.
4. SCOPE OF SERVICES
4.1 Peregrine Odyssey is an adventure travel company specialising in professionally curated motorcycle expeditions, road journeys, and related travel experiences across India and such other destinations as may be offered from time to time.
4.2 The services offered by Peregrine Odyssey may include, but are not limited to:
a. Guided motorcycle expeditions;
b. Private motorcycle tours;
c. Group motorcycle expeditions;
d. Custom-designed itineraries;
e. Motorcycle rental coordination through authorised third-party partners;
f. Accommodation arrangements;
g. Route planning;
h. Professional road captain services;
i. Support vehicle assistance where applicable;
j. Local logistical coordination;
k. Travel consultation;
l. Other travel-related services announced on the Website.
4.3 The scope, duration, itinerary, inclusions, exclusions, accommodation, support services, meal plans, motorcycle availability, pricing, and operational arrangements shall vary depending upon the expedition selected.
4.4 Information displayed on the Website is intended to provide a general overview of each expedition. Specific operational details may change before or during an expedition where reasonably necessary.
4.5 Peregrine Odyssey reserves the right to introduce, modify, suspend, or discontinue any expedition, service, destination, itinerary, package, feature, or offering without prior notice where reasonably required for operational, commercial, legal, or safety reasons.
4.6 Nothing contained on the Website shall constitute a guarantee that a particular expedition, accommodation, motorcycle model, destination, guide, road captain, hotel, restaurant, activity, or service shall remain continuously available.
4.7 Peregrine Odyssey shall make reasonable efforts to deliver each expedition substantially in accordance with the published itinerary. However, participants acknowledge that adventure travel is inherently dynamic and operational changes may become necessary.

5. ELIGIBILITY
5.1 By using the Website or booking any expedition, you represent and warrant that you possess the legal capacity to enter into a binding agreement under the laws applicable to you.
5.2 Unless otherwise specified for a particular expedition, participants must be at least eighteen (18) years of age on the commencement date of the expedition.
5.3 Participants under the age of eighteen may only participate where expressly permitted by Peregrine Odyssey and only with the written consent of their parent or legal guardian.
5.4 Participants operating motorcycles during an expedition must possess:
a. A valid driving licence legally authorising them to operate the relevant class of motorcycle;
b. Any permits or documentation required under applicable law;
c. Such additional documentation as may reasonably be required for participation.
5.5 International participants shall remain responsible for ensuring that they possess valid passports, visas, international driving permits (where applicable), travel authorisations, insurance documentation, vaccination certificates, and any other documents required for lawful travel.
5.6 Peregrine Odyssey reserves the right to verify any information provided by participants prior to confirming a booking.
5.7 Providing false, misleading, incomplete, fraudulent, or inaccurate information may result in:
a. cancellation of the booking;
b. refusal of participation;
c. suspension of the customer account;
d. forfeiture of applicable payments in accordance with the Cancellation & Refund Policy; and
e. any other action permitted under applicable law.
5.8 Eligibility to participate in one expedition does not automatically guarantee eligibility for future expeditions.

6. WEBSITE ACCESS AND USER RESPONSIBILITIES
6.1 Peregrine Odyssey grants users a limited, revocable, non-exclusive, non-transferable licence to access and use the Website solely for lawful personal or legitimate business purposes.
6.2 Users agree to access the Website responsibly and shall not:
a. use the Website for unlawful purposes;
b. interfere with the operation of the Website;
c. attempt to gain unauthorised access to any system or account;
d. upload malicious software;
e. transmit viruses, malware, spyware, ransomware, or harmful code;
f. interfere with other users' enjoyment of the Website;
g. circumvent security measures;
h. copy or scrape Website content using automated software without written permission;
i. reverse engineer any component of the Website except where expressly permitted by applicable law;
j. impersonate another person or organisation;
k. submit false enquiries or fraudulent bookings;
l. misuse promotional offers;
m. engage in activities likely to damage the reputation of Peregrine Odyssey.
6.3 Users shall ensure that all information submitted through the Website remains accurate, complete, and up to date.
6.4 Users shall remain solely responsible for maintaining adequate internet connectivity, compatible devices, browsers, and software required to access the Website.
6.5 Peregrine Odyssey may temporarily suspend access to the Website for:

b. emergency maintenance;
c. software upgrades;
d. security incidents;
e. infrastructure improvements;
f. regulatory compliance;

8.5 Peregrine Odyssey reserves the right to temporarily suspend or permanently disable any account where it reasonably believes that:

c. Multiple unauthorized login attempts have been detected;
d. Continued access may compromise the integrity or security of the Website or its users.
8.6 Peregrine Odyssey shall not be liable for any loss arising from your failure to maintain the confidentiality of your account credentials.

9. CUSTOMER REPRESENTATIONS AND WARRANTIES

9.2 Where you make a booking on behalf of multiple participants, you further represent and warrant that:
a. You are authorized to act on behalf of each participant;
b. Every participant has agreed to comply with these Terms;
c. You shall communicate all expedition-related information provided by Peregrine Odyssey to every participant.
9.3 You further acknowledge that failure to comply with these warranties may result in suspension or cancellation of your booking without prejudice to any other rights available to Peregrine Odyssey.

10. BOOKING PROCEDURE
10.1 Peregrine Odyssey accepts booking requests through its Website and through such other official communication channels as may be announced from time to time.
10.2 Submission of a booking request does not constitute acceptance of that booking by Peregrine Odyssey.
10.3 A booking request shall generally require:
a. Participant details;
b. Contact information;
c. Expedition selection;
d. Preferred travel dates;
e. Number of participants;
f. Any other information reasonably required for operational purposes.
10.4 Customers are responsible for ensuring that all information provided during the booking process is accurate.
10.5 Peregrine Odyssey reserves the right to request additional information before confirming any booking.
10.6 A booking shall remain subject to:
a. Availability of expedition seats;
b. Availability of accommodation;
c. Availability of motorcycle rentals where applicable;
d. Operational feasibility;
e. Successful verification of payment;
f. Compliance with these Terms.
10.7 Peregrine Odyssey may decline any booking where:
a. Required information is incomplete;
b. Fraud is suspected;
c. Payment verification fails;
d. Operational limitations prevent acceptance;
e. Participation may compromise the safety of the expedition;
f. Any participant fails to satisfy eligibility requirements.
10.8 Where a booking cannot be confirmed, Peregrine Odyssey shall make reasonable efforts to inform the customer at the earliest practicable opportunity.

11. BOOKING CONFIRMATION
11.1 A booking shall become confirmed only upon the issuance of an official Booking Confirmation by Peregrine Odyssey.
11.2 Booking confirmations may be issued by email or through any other official communication method designated by Peregrine Odyssey.
11.3 Customers are responsible for reviewing the Booking Confirmation immediately upon receipt.
11.4 Any discrepancy, error, omission, or inaccuracy in the Booking Confirmation should be reported promptly.
11.5 Peregrine Odyssey reserves the right to correct genuine clerical, typographical, computational, or administrative errors identified before the commencement of an expedition.
11.6 The Booking Confirmation shall include, where applicable:
a. Expedition name;
b. Expedition dates;
c. Participant details;
d. Payment status;
e. Package inclusions;
f. Meeting location;
g. Reporting instructions;
h. Other operational information relevant to the expedition.
11.7 Customers are responsible for ensuring that all participants possess the necessary documentation before the commencement of the expedition.

12. PRICING PRINCIPLES
12.1 All prices published by Peregrine Odyssey are displayed in Indian Rupees (INR) unless expressly stated otherwise.
12.2 Prices displayed on the Website are subject to change prior to booking confirmation.
12.3 Once a booking has been confirmed, the agreed expedition price shall ordinarily remain unchanged except where:
a. Taxes or statutory levies are modified by law;
b. Government charges materially change;
c. Customers request modifications to their booking;
d. Additional optional services are selected after booking confirmation;
e. Changes are expressly permitted under these Terms.
12.4 Expedition prices may vary depending upon:
a. Expedition destination;
b. Travel season;
c. Accommodation category;
d. Motorcycle selection;
e. Group size;
f. Operational costs;
g. Promotional offers;
h. Availability.
12.5 Unless expressly stated, expedition prices do not include:
a. Personal expenses;
b. Fuel costs;
c. Travel insurance;
d. Visa expenses;
e. Government permits unless specified;
f. Personal shopping;
g. Medical expenses;
h. Any services specifically identified as exclusions within the expedition itinerary.
12.6 Obvious pricing errors may be corrected by Peregrine Odyssey before booking confirmation. Where a confirmed booking is affected by a manifest pricing error, Peregrine Odyssey shall notify the customer and provide an opportunity to either proceed at the correct price or cancel the booking in accordance with applicable law.

13. TAXES AND STATUTORY CHARGES
13.1 Applicable taxes, including Goods and Services Tax (GST), shall be charged in accordance with the laws of India.
13.2 Customers shall remain responsible for paying all applicable taxes, duties, fees, levies, permits, or governmental charges associated with their booking unless expressly included within the expedition package.
13.3 Where tax laws change after booking confirmation, Peregrine Odyssey reserves the right to adjust the payable amount to the extent required by applicable law.
14. PAYMENT METHODS
14.1 Peregrine Odyssey shall accept payments through the payment methods made available on the Website or through officially authorised payment channels communicated by the Company from time to time.
14.2 As of the Last Updated date of these Terms, online payments are facilitated through Razorpay, an independent third-party payment gateway. Peregrine Odyssey does not control the operation of Razorpay and shall not be responsible for any interruption, delay, failure, or error arising from Razorpay's systems.
14.3 By choosing to make a payment through Razorpay, you agree to comply with the applicable terms, conditions, and privacy practices of Razorpay.
14.4 Peregrine Odyssey does not collect, store, or retain complete payment card numbers, CVV numbers, UPI PINs, internet banking passwords, or other confidential payment credentials.
14.5 Payment confirmation is subject to successful authorization by the relevant banking institution or payment service provider.
14.6 Peregrine Odyssey reserves the right to refuse any payment that:
a. Appears fraudulent;
b. Originates from suspicious or unauthorized sources;
c. Violates applicable laws;
d. Cannot be verified;
e. Is reversed or charged back without valid legal grounds.
14.7 Customers shall remain responsible for ensuring that sufficient funds are available to complete payment transactions.
14.8 Any transaction fees imposed by banks, card issuers, payment gateways, or financial institutions shall remain the responsibility of the customer unless expressly stated otherwise.

15. PAYMENT TERMS
15.1 Unless expressly stated otherwise for a specific expedition, full or partial payment may be required before a booking can be confirmed.
15.2 Peregrine Odyssey reserves the right to prescribe different payment schedules for different expeditions.
15.3 Failure to make payment within the prescribed time may result in:
a. Expiry of the booking request;
b. Cancellation of any provisional reservation;
c. Release of reserved expedition seats;
d. Revision of the applicable expedition price where permitted under these Terms.
15.4 Payment obligations shall not be considered fulfilled until the corresponding payment has been successfully received and confirmed.
15.5 Peregrine Odyssey reserves the right to suspend booking processing while payment verification is pending.
15.6 Where a payment fails after booking submission, Peregrine Odyssey may request that the customer repeat the payment process using another approved payment method.
15.7 Any refund arising from duplicate payments, erroneous payments, or overpayments shall be processed in accordance with applicable law and the Company's Cancellation & Refund Policy.
15.8 Customers acknowledge that banking institutions may require additional time to process refunds, reversals, or settlements. Peregrine Odyssey shall not be responsible for delays attributable solely to financial institutions or payment service providers.

16. PROMOTIONAL OFFERS, DISCOUNTS AND VOUCHERS
16.1 Peregrine Odyssey may, at its sole discretion, introduce promotional offers, early bird pricing, referral programmes, discount vouchers, promotional codes, loyalty rewards, seasonal campaigns, or other marketing initiatives.
16.2 Unless expressly stated otherwise:
a. Promotional offers shall be available only for the specified duration;
b. Offers may be limited to particular expeditions;
c. Offers may be restricted to selected users;
d. Promotional offers may be withdrawn without prior notice before a booking is confirmed.
16.3 Promotional codes:
a. Shall not be exchanged for cash;
b. Shall not be resold;
c. Shall not be transferred without written approval;
d. May not be combined with other promotions unless expressly permitted.
16.4 Peregrine Odyssey reserves the right to cancel any promotional benefit where fraud, misuse, manipulation, or violation of these Terms is reasonably suspected.
16.5 Where an expedition has been booked before a promotion becomes publicly available, customers shall not automatically become entitled to the newly announced promotional pricing.
16.6 Promotional campaigns shall not create any continuing right to future discounts.

17. AMENDMENTS PRIOR TO BOOKING CONFIRMATION
17.1 Before a booking has been confirmed, customers may request reasonable modifications to:
a. Participant information;
b. Contact details;
c. Motorcycle preference (subject to availability);
d. Accommodation preference where applicable;
e. Other booking information accepted by Peregrine Odyssey.
17.2 Peregrine Odyssey shall make reasonable efforts to accommodate requested changes; however, no amendment shall be guaranteed.
17.3 Requested modifications may:
a. Affect pricing;
b. Affect expedition availability;
c. Affect accommodation allocation;
d. Affect motorcycle availability;
e. Require additional verification.
17.4 Where requested amendments materially alter the booking, Peregrine Odyssey reserves the right to issue a revised quotation before confirmation.
17.5 Once a Booking Confirmation has been issued, subsequent amendments shall be governed by the Booking Policy and other applicable policies of Peregrine Odyssey.

18. CUSTOMER COMMUNICATIONS
18.1 By creating an account, making an enquiry, or submitting a booking request, you consent to receive communications from Peregrine Odyssey relating to your account, bookings, customer support requests, payment confirmations, itinerary updates, expedition notices, operational announcements, safety advisories, and other service-related information.
18.2 Peregrine Odyssey may communicate with customers through:
a. Email;
b. Telephone;
c. SMS;
d. WhatsApp or similar messaging platforms;
e. Website notifications;
f. Other officially designated communication channels.
18.3 Service-related communications shall not constitute marketing communications.
18.4 Where customers have separately consented to receive promotional communications, Peregrine Odyssey may periodically send information regarding:
a. Upcoming expeditions;
b. Promotional offers;
c. Newly introduced destinations;
d. Company announcements;
e. Other marketing communications.
18.5 Customers may opt out of promotional communications at any time using the unsubscribe mechanism provided or by contacting Peregrine Odyssey directly. Opting out of promotional communications shall not affect the delivery of essential service-related communications.

19. GENERAL PROVISIONS OF VOLUME I
19.1 Nothing contained within the Website shall constitute a legally binding offer capable of immediate acceptance. All expedition offerings remain subject to confirmation by Peregrine Odyssey.
19.2 Peregrine Odyssey reserves the right to correct typographical, computational, administrative, or clerical errors appearing on the Website or within any booking communication.
19.3 Delay or failure by Peregrine Odyssey in exercising any right under these Terms shall not constitute a waiver of that right.
19.4 If any provision contained within these Terms is determined by a competent court to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19.5 These Terms shall be interpreted fairly and in accordance with the ordinary meaning of their language unless otherwise required by applicable law.
19.6 Headings contained within these Terms are included solely for convenience and shall not affect their interpretation.
19.7 Volume I forms an integral part of the complete Terms & Conditions of Peregrine Odyssey and shall be read together with all subsequent volumes and all policies incorporated by reference.
EXPEDITION OPERATIONS

20. EXPEDITION SERVICES
20.1 Peregrine Odyssey specialises in professionally organised motorcycle expeditions designed to provide participants with safe, immersive, and memorable travel experiences while exploring selected destinations.
20.2 Expeditions offered by Peregrine Odyssey may include, without limitation:
a. Guided motorcycle expeditions;
b. Private motorcycle expeditions;
c. Group motorcycle expeditions;
d. Corporate expeditions;
e. Custom-designed journeys;
f. Adventure riding experiences;
g. Cultural exploration tours;
h. Photography expeditions;
i. Other expedition services announced by the Company.
20.3 The precise nature of each expedition shall be described on the relevant expedition page and in the Booking Confirmation.
20.4 Expedition descriptions, itineraries, estimated travel durations, accommodation information, route maps, photographs, and promotional material are provided for informational purposes only and shall not be interpreted as guarantees that every aspect of an expedition will occur exactly as described.
20.5 Peregrine Odyssey continually evaluates its expeditions to improve participant experience and therefore reserves the right to reasonably modify operational arrangements where necessary.

21. GROUP EXPEDITIONS
21.1 A Group Expedition consists of multiple participants travelling together according to a common itinerary under the supervision of Peregrine Odyssey.
21.2 Group expeditions are conducted according to predetermined schedules, routes, accommodation arrangements, meeting points, and operational procedures established by the Company.
21.3 Participants acknowledge that travelling in a group requires cooperation, discipline, punctuality, and mutual respect.
21.4 During a Group Expedition, participants agree to:
a. Follow instructions issued by the Road Captain and expedition staff;
b. Arrive punctually at all designated meeting points;
c. Respect other participants;
d. Avoid conduct likely to disrupt the expedition;
e. Maintain reasonable riding discipline.
21.5 Peregrine Odyssey reserves the right to modify group composition where operationally necessary.
21.6 No participant shall be entitled to demand exclusive attention from expedition staff during a Group Expedition except in circumstances involving health, safety, or emergencies.

22. PRIVATE EXPEDITIONS
22.1 Peregrine Odyssey may offer customised Private Expeditions for individuals, families, or private groups.
22.2 A Private Expedition may be customised with respect to:
a. Travel dates;
b. Destinations;
c. Accommodation preferences;
d. Motorcycle selection;
e. Route planning;
f. Duration;
g. Additional support services.
22.3 Customisation requests remain subject to operational feasibility and availability.
22.4 A quotation provided for a Private Expedition shall remain valid only for the period specified by Peregrine Odyssey.
22.5 Once confirmed, any significant modification requested by the customer may result in revised pricing and additional operational charges.

23. EXPEDITION ITINERARY
23.1 Every expedition shall operate according to an itinerary prepared by Peregrine Odyssey.
23.2 The itinerary may include:
a. Daily riding schedule;
b. Accommodation;
c. Meal arrangements;
d. Fuel stops;
e. Sightseeing locations;
f. Rest periods;
g. Emergency procedures;
h. Reporting times.
23.3 All itineraries are indicative and are intended to provide participants with a reasonable expectation of the expedition.
23.4 Participants acknowledge that actual travel conditions may differ from the planned itinerary.
23.5 Peregrine Odyssey reserves the right to amend any itinerary before or during an expedition where reasonably necessary.
23.6 Such amendments may occur due to:
a. Weather conditions;
b. Road closures;
c. Landslides;
d. Flooding;
e. Government restrictions;
f. Security considerations;
g. Medical emergencies;
h. Mechanical issues;
i. Operational requirements;
j. Any other circumstance affecting participant safety or expedition success.

24.1 Participants shall report at the designated meeting location within the reporting time communicated by Peregrine Odyssey.
24.2 Failure to report within the prescribed reporting time may result in forfeiture of participation without entitlement to compensation, except where otherwise required by law or expressly agreed by Peregrine Odyssey.
24.3 Participants remain responsible for arranging their transportation to the designated reporting location unless expressly included within the expedition package.
24.4 Peregrine Odyssey shall not be responsible for delays arising from:
a. Flight delays;
b. Railway delays;
c. Traffic congestion;
d. Personal scheduling errors;
e. Missed connections;
f. Circumstances beyond the Company's reasonable control.

25. ACCOMMODATION
25.1 Accommodation arrangements shall be provided only where expressly included within the booked expedition.
25.2 Accommodation categories, room types, occupancy, and amenities may vary depending upon:
a. Destination;
b. Availability;
c. Local infrastructure;
d. Seasonal demand;
e. Operational requirements.
25.3 Photographs displayed on the Website are intended to represent the general standard of accommodation and may not depict the exact room assigned.
25.4 Peregrine Odyssey reserves the right to substitute accommodation with an alternative property of comparable standard where reasonably necessary.
25.5 Accommodation providers maintain their own policies concerning:
a. Check-in;
b. Check-out;
c. House rules;
d. Damage;
e. Guest conduct.
Participants agree to comply with such policies.
25.6 Participants shall remain financially responsible for any damage caused by them to accommodation properties.

26. MEALS
26.1 Meal inclusions shall be specified within the expedition description.
26.2 Dietary preferences, allergies, vegan requirements, vegetarian meals, or other special requests should be communicated before the expedition.
26.3 Peregrine Odyssey shall make reasonable efforts to accommodate dietary requests but cannot guarantee availability in remote destinations.
26.4 Participants acknowledge that meal options in remote mountainous regions may be limited by geography, weather, and local availability.
26.5 No refund shall ordinarily be payable where a participant voluntarily declines an included meal.

27. MOTORCYCLE RENTALS
27.1 Peregrine Odyssey may facilitate motorcycle rentals through independent third-party rental providers.
27.2 Peregrine Odyssey does not manufacture, own, or guarantee the motorcycles supplied by independent rental partners unless expressly stated otherwise.
27.3 Motorcycle availability remains subject to:
a. Fleet availability;
b. Mechanical condition;
c. Seasonal demand;
d. Operational logistics.
27.4 While reasonable efforts shall be made to provide the selected motorcycle model, Peregrine Odyssey reserves the right to substitute a motorcycle with another model of similar category where reasonably necessary.
27.5 Participants renting motorcycles shall:
a. Hold a valid driving licence;
b. Inspect the motorcycle before departure;
c. Immediately report any observed defects;
d. Operate the motorcycle responsibly;
e. Comply with all applicable traffic laws.
27.6 Damage caused through negligent or unlawful operation may remain the financial responsibility of the participant in accordance with the applicable rental agreement.
28. SELF-OWNED MOTORCYCLES
28.1 Participants choosing to ride their own motorcycles shall ensure that their motorcycle is mechanically roadworthy before the commencement of the expedition.
28.2 Prior to departure, participants are solely responsible for verifying that their motorcycle possesses, where applicable:
a. Valid Registration Certificate (RC);
b. Valid motor insurance;
c. Valid Pollution Under Control (PUC) Certificate;
d. Any permits required under applicable law;
e. Any additional documentation legally required for operation.
28.3 Peregrine Odyssey may conduct a visual inspection of motorcycles before the commencement of an expedition. Such inspection is solely for operational and safety purposes and shall not constitute a technical certification of roadworthiness.
28.4 Participants acknowledge that Peregrine Odyssey shall not be responsible for any mechanical defect, manufacturing fault, maintenance issue, or breakdown relating to a participant's privately owned motorcycle.
28.5 Participants remain solely responsible for:
a. Fuel;
b. Routine maintenance;
c. Tyre condition;
d. Brake performance;
e. Chain maintenance;
f. Battery condition;
g. Engine oil;
h. Spare keys;
i. All maintenance expenses relating to their motorcycle.
28.6 Where a privately owned motorcycle becomes incapable of safely continuing the expedition, Peregrine Odyssey may recommend that the participant discontinue riding until the issue has been appropriately resolved.
28.7 Peregrine Odyssey reserves the right to prohibit the use of any motorcycle that reasonably appears unsafe for the planned expedition.

29. SUPPORT VEHICLE
29.1 Certain expeditions may include a support vehicle for operational assistance.
29.2 The support vehicle may provide assistance relating to:
a. Luggage transportation;
b. Emergency logistics;
c. Mechanical support;
d. First aid equipment;
e. Spare fuel where operationally appropriate;
f. Communication equipment;
g. Other logistical requirements.
29.3 Inclusion of a support vehicle shall be specified within the expedition details.
29.4 The support vehicle is intended to support the expedition as a whole and shall not function as a private transportation service for individual participants.
29.5 Peregrine Odyssey reserves the right to determine how support vehicle resources are allocated during the expedition.
29.6 Participants acknowledge that seating within the support vehicle may be limited.
29.7 The support vehicle shall not ordinarily transport participants except where:
a. A medical emergency arises;
b. Safety requires transportation;
c. A motorcycle becomes temporarily inoperable;
d. Operational circumstances reasonably require such transportation.
29.8 The availability of a support vehicle does not guarantee uninterrupted mechanical recovery services throughout the expedition.

30. ROAD CAPTAIN
30.1 Every guided expedition shall ordinarily be supervised by one or more Road Captains appointed by Peregrine Odyssey.
30.2 The Road Captain is responsible for:
a. Leading the expedition;
b. Coordinating the riding group;
c. Managing daily schedules;
d. Providing route guidance;
e. Promoting safe riding practices;
f. Responding to operational issues;
g. Coordinating with local authorities where necessary.
30.3 Participants agree to follow reasonable instructions issued by the Road Captain throughout the expedition.
30.4 Instructions issued by the Road Captain relating to participant safety shall take precedence over individual riding preferences.
30.5 The Road Captain may temporarily stop the expedition whenever reasonably necessary due to:
a. Hazardous road conditions;
b. Weather;
c. Mechanical issues;
d. Medical emergencies;
e. Traffic conditions;
f. Safety concerns.
30.6 Persistent refusal to comply with reasonable safety instructions may result in removal from the expedition without entitlement to compensation, subject to applicable law.

31. FUEL
31.1 Unless expressly stated within the expedition description, fuel costs are not included within the expedition price.
31.2 Participants remain responsible for ensuring that their motorcycle maintains sufficient fuel for each stage of the expedition.
31.3 Participants should refuel whenever directed by the Road Captain, particularly before entering remote regions where fuel stations may be limited.
31.4 Peregrine Odyssey shall not be responsible for delays arising solely from a participant's failure to maintain an adequate fuel level.
31.5 Participants acknowledge that fuel availability in remote mountainous regions may be affected by:
a. Weather;
b. Road closures;
c. Transportation disruptions;
d. Local shortages;
e. Government restrictions.

32. LUGGAGE
32.1 Participants shall travel with luggage suitable for motorcycle expeditions.
32.2 Peregrine Odyssey may specify luggage limits before the commencement of an expedition.
32.3 Participants are responsible for ensuring that luggage is appropriately secured during transportation.
32.4 Peregrine Odyssey recommends that participants avoid carrying unnecessary valuables.
32.5 Participants remain solely responsible for:
a. Personal documents;
b. Cameras;
c. Mobile phones;
d. Laptops;
e. Jewellery;
f. Cash;
g. Other personal valuables.
32.6 Where luggage is transported within a support vehicle, Peregrine Odyssey shall exercise reasonable care but shall not be responsible for ordinary wear and tear, minor cosmetic damage, or loss arising from circumstances beyond its reasonable control.
32.7 Participants should immediately report any missing luggage to expedition staff.

33. RIDING FORMATION
33.1 For the safety of all participants, Peregrine Odyssey may require riders to travel in a designated riding formation.
33.2 Participants shall maintain reasonable following distances appropriate to prevailing road, traffic, and weather conditions.
33.3 Participants shall not overtake the Road Captain or designated lead rider unless expressly instructed.
33.4 Dangerous riding practices, including excessive speeding, reckless overtaking, racing, or deliberate endangerment of other road users, are strictly prohibited.
33.5 Participants shall operate motorcycles in accordance with all applicable traffic laws throughout the expedition.
33.6 Peregrine Odyssey reserves the right to issue safety warnings or remove participants from an expedition where their riding behaviour presents a material risk to themselves or others.

34. COMMUNICATION DURING EXPEDITIONS
34.1 Peregrine Odyssey may communicate expedition-related information through verbal briefings, messaging applications, telephone calls, radio equipment, or other appropriate communication methods.
34.2 Participants shall provide a valid mobile contact number prior to the expedition.
34.3 Participants should promptly inform expedition staff of:
a. Medical concerns;
b. Mechanical issues;
c. Delays;
d. Accidents;
e. Emergencies;
f. Circumstances affecting their continued participation.
34.4 Participants acknowledge that mobile network coverage may be unavailable in certain remote locations and that communication interruptions may occur beyond the reasonable control of Peregrine Odyssey.

35. LOCAL LAWS, CULTURAL RESPECT AND ENVIRONMENTAL RESPONSIBILITY
35.1 Participants shall comply with all applicable laws, regulations, permits, and lawful directions issued by governmental authorities during the expedition.
35.2 Participants shall conduct themselves respectfully toward local communities, customs, traditions, religious sites, and cultural practices.
35.3 Participants shall avoid behaviour that may reasonably be regarded as offensive, discriminatory, disruptive, or unlawful.
35.4 Participants shall make reasonable efforts to minimise their environmental impact by:
a. Avoiding littering;
b. Disposing of waste responsibly;
c. Respecting wildlife;
d. Remaining on designated routes where required;
e. Avoiding unnecessary environmental damage.
35.5 Participants acknowledge that Peregrine Odyssey promotes responsible and sustainable tourism and expects all participants to contribute positively to the destinations visited.
35.6 Serious or repeated violations of applicable laws or conduct that materially endangers the safety, reputation, or operations of Peregrine Odyssey may result in immediate removal from the expedition, without prejudice to any other rights or remedies available under these Terms or applicable law.
36. RIDER CONDUCT AND CODE OF BEHAVIOUR
36.1 Every participant is expected to conduct themselves in a manner that reflects courtesy, professionalism, responsibility, and respect towards fellow participants, expedition staff, local communities, accommodation providers, government authorities, and members of the public.
36.2 Participants acknowledge that motorcycle expeditions involve close coordination amongst all members of the group. Behaviour that jeopardises the safety, enjoyment, or well-being of others shall not be tolerated.
36.3 Throughout the expedition, participants shall:
a. Treat fellow participants with dignity and respect;
b. Cooperate with expedition staff and Road Captains;
c. Maintain punctuality for all scheduled departures, briefings, meals, and activities;
d. Respect local customs, religious beliefs, traditions, and cultural practices;
e. Exercise good judgment while riding and during all expedition-related activities.
36.4 Participants shall refrain from:
a. Abusive or threatening behaviour;
b. Physical violence;
c. Harassment;
d. Discrimination based on race, religion, ethnicity, nationality, disability, gender, or any other protected characteristic;
e. Intimidation of other participants;
f. Damage to public or private property;
g. Conduct likely to bring Peregrine Odyssey into disrepute.
36.5 Persistent disruptive behaviour may result in disciplinary action, including removal from the expedition without entitlement to compensation, subject to applicable law.

37. MANDATORY RIDING GEAR
37.1 Participant safety is a fundamental priority of Peregrine Odyssey.
37.2 Every rider shall wear an approved protective helmet meeting applicable legal standards while operating a motorcycle during the expedition.
37.3 Peregrine Odyssey strongly recommends the use of the following protective riding equipment throughout the expedition:
a. Riding jacket with protective armour;
b. Riding trousers or equivalent protective apparel;
c. Riding gloves;
d. Riding boots providing adequate ankle protection;
e. Knee protection;
f. Elbow protection;
g. Rain gear suitable for mountainous environments;
h. High-visibility apparel where appropriate.
37.4 Participants acknowledge that failure to wear appropriate riding gear significantly increases the risk of serious injury.
37.5 Peregrine Odyssey reserves the right to refuse participation where a rider appears inadequately equipped for the planned expedition.
37.6 Participants remain solely responsible for ensuring that all personal riding equipment is:
a. Properly fitted;
b. Well maintained;
c. Appropriate for prevailing weather conditions;
d. Suitable for the terrain to be encountered.

38. ALCOHOL, DRUGS AND INTOXICATION
38.1 Participant safety requires that motorcycles be operated only by individuals who are fully alert and capable of exercising sound judgment.
38.2 Participants shall not operate a motorcycle while:
a. Under the influence of alcohol;
b. Under the influence of narcotic substances;
c. Under the influence of illegal drugs;
d. Impaired by medication affecting riding ability.
38.3 Consumption of alcohol shall not excuse any breach of these Terms.
38.4 Peregrine Odyssey reserves the right to prohibit any participant from riding where there are reasonable grounds to believe that the participant's ability to ride safely is impaired.
38.5 Where participant conduct presents an immediate safety risk, Peregrine Odyssey may remove that participant from the expedition without liability for any resulting losses, subject to applicable law.
38.6 Participants remain personally responsible for complying with all laws relating to alcohol, controlled substances, and driving.

39. MEDICAL FITNESS AND HEALTH DECLARATIONS
39.1 Motorcycle expeditions may involve prolonged riding, varying weather conditions, high-altitude environments, remote regions, and physically demanding activities.
39.2 Each participant is responsible for ensuring that they are medically fit to participate in the expedition.
39.3 Participants should disclose any medical condition that could reasonably affect their ability to participate safely where such disclosure is requested during the booking process or before departure.
39.4 Such conditions may include, without limitation:
a. Cardiovascular disorders;
b. Respiratory illnesses;
c. Epilepsy;
d. Severe allergies;
e. Diabetes requiring emergency intervention;
f. Mobility limitations;
g. Any condition requiring immediate medical attention during travel.
39.5 Participants remain responsible for carrying adequate personal medication throughout the expedition.
39.6 Peregrine Odyssey shall not be responsible for administering medication except for reasonable first-aid assistance where appropriate.
39.7 Participants are encouraged to consult their medical practitioner before undertaking any expedition involving significant altitude, remote travel, or prolonged motorcycle riding.

40. EMERGENCIES DURING THE EXPEDITION
40.1 In the event of an emergency, participants agree to follow all reasonable instructions issued by the Road Captain or authorised expedition personnel.
40.2 Emergencies may include:
a. Medical emergencies;
b. Road accidents;
c. Mechanical failures creating immediate danger;
d. Natural disasters;
e. Security incidents;
f. Severe weather;
g. Road blockages;
h. Other unforeseen operational events.
40.3 Peregrine Odyssey shall make reasonable efforts to coordinate emergency assistance appropriate to the circumstances.
40.4 Participants acknowledge that expeditions may operate in remote regions where emergency medical services, communication networks, recovery vehicles, or hospitals may not be immediately available.
40.5 Emergency decisions taken by the Road Captain shall be made in the interests of participant safety and operational practicality.

41. MECHANICAL BREAKDOWNS
41.1 Participants acknowledge that motorcycles are mechanical machines and may occasionally experience unforeseen failures.
41.2 Where a rented motorcycle develops a mechanical issue not caused by participant negligence, Peregrine Odyssey shall make reasonable efforts to coordinate repairs or arrange an appropriate replacement where operationally feasible.
41.3 Participants using privately owned motorcycles remain responsible for the maintenance and repair of those motorcycles unless otherwise expressly agreed.
41.4 Peregrine Odyssey does not guarantee immediate availability of replacement motorcycles or spare parts, particularly in remote regions.
41.5 Temporary delays arising from mechanical repairs shall not ordinarily constitute a breach of these Terms.

42. PHOTOGRAPHY, VIDEOGRAPHY AND DRONES DURING EXPEDITIONS
42.1 Participants are welcome to take photographs and videos for personal, non-commercial purposes, provided such activities do not compromise safety, privacy, or applicable law.
42.2 Participants operating cameras, action cameras, drones, or similar equipment remain solely responsible for complying with all applicable laws, regulations, permit requirements, and restrictions.
42.3 Drone operations may be prohibited or restricted in certain areas, including near airports, military establishments, protected areas, or locations designated by governmental authorities.
42.4 Participants shall obtain any permissions required by law before operating drone equipment.
42.5 Peregrine Odyssey shall not be responsible for the confiscation, loss, damage, or legal consequences arising from the unlawful use of drones or other recording equipment.

43. WILDLIFE, PROTECTED AREAS AND RESTRICTED ZONES
43.1 Participants shall comply with all laws governing national parks, wildlife sanctuaries, protected forests, environmentally sensitive areas, and other protected locations visited during an expedition.
43.2 Participants shall not disturb wildlife, damage vegetation, remove natural objects, feed wild animals, or engage in activities prohibited by applicable law.
43.3 Where permits are required for entry into restricted areas, participants shall cooperate in providing any information reasonably necessary to obtain such permits.
43.4 Access to certain destinations may be denied or restricted by governmental authorities at any time. Peregrine Odyssey shall not be liable where such restrictions require modification of the expedition itinerary.
43.5 Participants shall respect all instructions issued by forest officials, military personnel, local authorities, or other competent governmental agencies.
44. ACCOMMODATION CONDUCT
44.1 Participants shall conduct themselves responsibly while staying at any hotel, guest house, homestay, campsite, resort, lodge, or other accommodation arranged as part of an expedition.
44.2 Participants shall comply with all reasonable house rules established by the accommodation provider, including rules relating to check-in, check-out, noise levels, smoking, alcohol consumption, use of facilities, safety, and security.
44.3 Participants shall respect the privacy, comfort, and peaceful enjoyment of other guests staying at the accommodation.
44.4 Unless expressly included in the expedition package, incidental expenses incurred at the accommodation, including but not limited to room service, minibar purchases, laundry services, telephone charges, recreational facilities, spa services, or other optional amenities, shall remain the sole responsibility of the participant.
44.5 Participants shall remain financially responsible for any loss, damage, or excessive cleaning costs caused by their negligent, reckless, or intentional acts at the accommodation.
44.6 Peregrine Odyssey shall not be responsible for disputes arising directly between participants and accommodation providers concerning personal conduct, damage, or incidental charges.
44.7 Accommodation providers reserve the right to deny services or remove any guest whose conduct materially breaches their policies or applicable law.

45. RESPONSIBLE TOURISM AND ENVIRONMENTAL COMMITMENT
45.1 Peregrine Odyssey is committed to promoting responsible tourism and expects all participants to contribute positively to the preservation of the natural environment, local communities, and cultural heritage.
45.2 Participants shall make reasonable efforts to minimise their environmental impact throughout the expedition.
45.3 Participants agree to:
a. Avoid littering;
b. Use designated waste disposal facilities;
c. Minimise unnecessary plastic waste where practicable;
d. Respect wildlife and natural habitats;
e. Avoid damaging vegetation or natural formations;
f. Follow instructions applicable to protected ecological areas.
45.4 Participants shall respect local customs, languages, traditions, religious sites, monuments, and places of cultural significance.
45.5 Collection of plants, wildlife, rocks, archaeological artefacts, or culturally significant objects from expedition destinations is strictly prohibited unless expressly authorised by the competent governmental authority.
45.6 Peregrine Odyssey encourages participants to support local communities through respectful interaction and responsible purchasing from local businesses where appropriate.
45.7 Failure to comply with environmental or cultural protection requirements may result in removal from certain activities or, in serious cases, from the expedition.

46. PARTICIPANT REMOVAL FROM AN EXPEDITION
46.1 Peregrine Odyssey reserves the right to remove a participant from an expedition where continued participation would reasonably be expected to:
a. Endanger the participant;
b. Endanger other participants;
c. Endanger expedition staff;
d. Disrupt expedition operations;
e. Damage the reputation of Peregrine Odyssey;
f. Result in unlawful conduct.
46.2 Grounds for removal may include, without limitation:
a. Persistent refusal to follow reasonable safety instructions;
b. Dangerous riding behaviour;
c. Physical violence;
d. Harassment;
e. Threatening behaviour;
f. Serious intoxication;
g. Possession or use of illegal drugs;
h. Deliberate property damage;
i. Criminal conduct;
j. Repeated material breaches of these Terms.
46.3 Before removing a participant, Peregrine Odyssey shall, where reasonably practicable and having regard to safety and the circumstances, provide the participant with an opportunity to comply with the relevant instructions or cease the offending conduct.
46.4 Immediate removal without prior warning may occur where Peregrine Odyssey reasonably believes that immediate action is necessary to protect the safety or security of participants, staff, or the public.
46.5 A participant removed from an expedition shall remain responsible for:
a. Personal transportation;
b. Accommodation expenses incurred after removal;
c. Any additional travel costs;
d. Any liabilities arising from their own conduct.
46.6 Removal from an expedition shall not automatically entitle the participant to a refund. Any entitlement to a refund shall be determined in accordance with these Terms, the Cancellation & Refund Policy, applicable law, and the circumstances of the removal.

47. COMPLETION OF THE EXPEDITION
47.1 An expedition shall ordinarily conclude at the destination, date, and time specified in the confirmed itinerary, subject to reasonable operational modifications.
47.2 Upon completion of the expedition, Peregrine Odyssey's obligations under the booked expedition shall be deemed fulfilled, except for any obligations that expressly survive termination or completion under these Terms or applicable law.
47.3 Participants are responsible for arranging any onward travel, accommodation, or transportation required after the official conclusion of the expedition unless such arrangements form part of the booked package.
47.4 Any services requested by a participant after the official conclusion of the expedition shall be subject to separate availability, pricing, and agreement.

48. CUSTOMER FEEDBACK, REVIEWS AND COMPLAINTS
48.1 Peregrine Odyssey values constructive feedback and encourages participants to share their experiences following an expedition.
48.2 Participants may submit feedback through the Website, email, or other officially designated communication channels.
48.3 Peregrine Odyssey may invite participants to publish reviews regarding their expedition experience.
48.4 Participants agree that any review submitted shall:
a. Be truthful;
b. Reflect their genuine experience;
c. Not contain knowingly false, misleading, defamatory, abusive, or unlawful statements;
d. Respect the privacy of other participants and staff.
48.5 Peregrine Odyssey reserves the right to remove or decline to publish reviews that violate these Terms or applicable law.
48.6 Complaints relating to an expedition should, where reasonably practicable, be brought to the attention of the Road Captain or expedition staff during the expedition so that reasonable efforts may be made to address the issue promptly.
48.7 Where a complaint cannot be resolved during the expedition, participants may submit a written complaint to Peregrine Odyssey after the expedition concludes. The Company shall make reasonable efforts to review and respond to such complaints within a reasonable period.

49. POST-EXPEDITION RESPONSIBILITIES
49.1 Participants remain responsible for returning any equipment, documents, or property belonging to Peregrine Odyssey or its authorised partners that has been temporarily provided during the expedition.
49.2 Participants shall promptly settle any outstanding payments lawfully due in connection with the expedition.
49.3 Participants are encouraged to inform Peregrine Odyssey of any significant safety concerns or operational issues identified during the expedition to assist in improving future expeditions.
49.4 Any rights or obligations under these Terms that by their nature are intended to survive the completion or termination of an expedition—including, without limitation, provisions relating to intellectual property, limitation of liability, indemnity, governing law, dispute resolution, and privacy—shall continue in effect.

50. GENERAL PROVISIONS OF VOLUME II
50.1 The operational arrangements described in this Volume are intended to promote participant safety, expedition efficiency, and a positive travel experience.
50.2 Peregrine Odyssey reserves the right to issue additional operational guidelines before or during an expedition where reasonably necessary to address specific destinations, weather conditions, local regulations, or safety considerations.
50.3 Participants agree to comply with such reasonable operational guidelines provided they do not materially conflict with these Terms or applicable law.
50.4 Nothing in this Volume shall limit any statutory rights available to participants under applicable consumer protection laws.
50.5 This Volume shall be read together with all other Volumes of these Terms & Conditions and with all policies incorporated by reference.

51. ACKNOWLEDGEMENT OF ADVENTURE ACTIVITIES

b. Mountainous terrain;
c. High-altitude environments;
d. Unpredictable weather conditions;
e. Narrow or unpaved roads;
f. Reduced medical accessibility;
g. Mechanical failures;
h. Wildlife encounters;
i. Remote locations with limited communication infrastructure;
j. Other inherent risks associated with adventure travel.
51.3 Participants understand that while Peregrine Odyssey adopts reasonable safety practices, no expedition can eliminate all risks associated with adventure travel.
51.4 Participation in any expedition is voluntary.

52.3 Participants acknowledge that physical injury, illness, property damage, financial loss, or, in exceptional circumstances, death may occur despite reasonable safety measures.

60. REFUNDS

60.2 Refunds shall not be automatic merely because a booking has been cancelled.
60.3 Any refund shall be subject to:
a. The reason for cancellation;

5.7 Providing false, misleading, incomplete, fraudulent, or inaccurate information may result in:

11.1 A booking shall become confirmed only upon the issuance of an official Booking Confirmation by Peregrine Odyssey.

11.3 Customers are responsible for reviewing the Booking Confirmation immediately upon receipt.

11.7 Customers are responsible for ensuring that all participants possess the necessary documentation before the commencement of the expedition.

13. TAXES AND STATUTORY CHARGES
13.1 Applicable taxes, including Goods and Services Tax (GST), shall be charged in accordance with the laws of India.

14. PAYMENT METHODS

14.2 As of the Last Updated date of these Terms, online payments are facilitated through Razorpay, an independent third-party payment gateway. Peregrine Odyssey does not control the operation of Razorpay and shall not be responsible for any interruption, delay, failure, or error arising from Razorpay's systems.
14.3 By choosing to make a payment through Razorpay, you agree to comply with the applicable terms, conditions, and privacy practices of Razorpay.
14.4 Peregrine Odyssey does not collect, store, or retain complete payment card numbers, CVV numbers, UPI PINs, internet banking passwords, or other confidential payment credentials.

20.5 Peregrine Odyssey continually evaluates its expeditions to improve participant experience and therefore reserves the right to reasonably modify operational arrangements where necessary.

21. GROUP EXPEDITIONS
21.1 A Group Expedition consists of multiple participants travelling together according to a common itinerary under the supervision of Peregrine Odyssey.
21.2 Group expeditions are conducted according to predetermined schedules, routes, accommodation arrangements, meeting points, and operational procedures established by the Company.
21.3 Participants acknowledge that travelling in a group requires cooperation, discipline, punctuality, and mutual respect.
21.4 During a Group Expedition, participants agree to:
a. Follow instructions issued by the Road Captain and expedition staff;
b. Arrive punctually at all designated meeting points;
c. Respect other participants;
d. Avoid conduct likely to disrupt the expedition;
e. Maintain reasonable riding discipline.
21.5 Peregrine Odyssey reserves the right to modify group composition where operationally necessary.
21.6 No participant shall be entitled to demand exclusive attention from expedition staff during a Group Expedition except in circumstances involving health, safety, or emergencies.

22. PRIVATE EXPEDITIONS

22.5 Once confirmed, any significant modification requested by the customer may result in revised pricing and additional operational charges.

23.1 Every expedition shall operate according to an itinerary prepared by Peregrine Odyssey.

f. Rest periods;
g. Emergency procedures;

23.3 All itineraries are indicative and are intended to provide participants with a reasonable expectation of the expedition.
23.4 Participants acknowledge that actual travel conditions may differ from the planned itinerary.
23.5 Peregrine Odyssey reserves the right to amend any itinerary before or during an expedition where reasonably necessary.
23.6 Such amendments may occur due to:
a. Weather conditions;
b. Road closures;
c. Landslides;
d. Flooding;
e. Government restrictions;
f. Security considerations;
g. Medical emergencies;
h. Mechanical issues;
i. Operational requirements;
j. Any other circumstance affecting participant safety or expedition success.
23.7 Reasonable itinerary modifications shall not constitute a breach of these Terms.

24. REPORTING TIME AND COMMENCEMENT OF EXPEDITION
24.1 Participants shall report at the designated meeting location within the reporting time communicated by Peregrine Odyssey.
24.2 Failure to report within the prescribed reporting time may result in forfeiture of participation without entitlement to compensation, except where otherwise required by law or expressly agreed by Peregrine Odyssey.
24.3 Participants remain responsible for arranging their transportation to the designated reporting location unless expressly included within the expedition package.
24.4 Peregrine Odyssey shall not be responsible for delays arising from:
a. Flight delays;
b. Railway delays;
c. Traffic congestion;
d. Personal scheduling errors;
e. Missed connections;
f. Circumstances beyond the Company's reasonable control.

25. ACCOMMODATION
25.1 Accommodation arrangements shall be provided only where expressly included within the booked expedition.
25.2 Accommodation categories, room types, occupancy, and amenities may vary depending upon:

e. Operational requirements.
25.3 Photographs displayed on the Website are intended to represent the general standard of accommodation and may not depict the exact room assigned.
25.4 Peregrine Odyssey reserves the right to substitute accommodation with an alternative property of comparable standard where reasonably necessary.
25.5 Accommodation providers maintain their own policies concerning:
a. Check-in;
b. Check-out;
c. House rules;
d. Damage;
e. Guest conduct.
Participants agree to comply with such policies.
25.6 Participants shall remain financially responsible for any damage caused by them to accommodation properties.

26. MEALS

26.5 No refund shall ordinarily be payable where a participant voluntarily declines an included meal.

27. MOTORCYCLE RENTALS
27.1 Peregrine Odyssey may facilitate motorcycle rentals through independent third-party rental providers.
27.2 Peregrine Odyssey does not manufacture, own, or guarantee the motorcycles supplied by independent rental partners unless expressly stated otherwise.
27.3 Motorcycle availability remains subject to:
a. Fleet availability;
b. Mechanical condition;
c. Seasonal demand;
d. Operational logistics.
27.4 While reasonable efforts shall be made to provide the selected motorcycle model, Peregrine Odyssey reserves the right to substitute a motorcycle with another model of similar category where reasonably necessary.
27.5 Participants renting motorcycles shall:
a. Hold a valid driving licence;
b. Inspect the motorcycle before departure;
c. Immediately report any observed defects;
d. Operate the motorcycle responsibly;
e. Comply with all applicable traffic laws.
27.6 Damage caused through negligent or unlawful operation may remain the financial responsibility of the participant in accordance with the applicable rental agreement.
28. SELF-OWNED MOTORCYCLES
28.1 Participants choosing to ride their own motorcycles shall ensure that their motorcycle is mechanically roadworthy before the commencement of the expedition.
28.2 Prior to departure, participants are solely responsible for verifying that their motorcycle possesses, where applicable:
a. Valid Registration Certificate (RC);
b. Valid motor insurance;
c. Valid Pollution Under Control (PUC) Certificate;
d. Any permits required under applicable law;
e. Any additional documentation legally required for operation.
28.3 Peregrine Odyssey may conduct a visual inspection of motorcycles before the commencement of an expedition. Such inspection is solely for operational and safety purposes and shall not constitute a technical certification of roadworthiness.
28.4 Participants acknowledge that Peregrine Odyssey shall not be responsible for any mechanical defect, manufacturing fault, maintenance issue, or breakdown relating to a participant's privately owned motorcycle.
28.5 Participants remain solely responsible for:
a. Fuel;
b. Routine maintenance;
c. Tyre condition;
d. Brake performance;
e. Chain maintenance;
f. Battery condition;
g. Engine oil;
h. Spare keys;
i. All maintenance expenses relating to their motorcycle.
28.6 Where a privately owned motorcycle becomes incapable of safely continuing the expedition, Peregrine Odyssey may recommend that the participant discontinue riding until the issue has been appropriately resolved.
28.7 Peregrine Odyssey reserves the right to prohibit the use of any motorcycle that reasonably appears unsafe for the planned expedition.

29. SUPPORT VEHICLE
29.1 Certain expeditions may include a support vehicle for operational assistance.
29.2 The support vehicle may provide assistance relating to:
a. Luggage transportation;
b. Emergency logistics;
c. Mechanical support;
d. First aid equipment;
e. Spare fuel where operationally appropriate;
f. Communication equipment;
g. Other logistical requirements.
29.3 Inclusion of a support vehicle shall be specified within the expedition details.
29.4 The support vehicle is intended to support the expedition as a whole and shall not function as a private transportation service for individual participants.
29.5 Peregrine Odyssey reserves the right to determine how support vehicle resources are allocated during the expedition.
29.6 Participants acknowledge that seating within the support vehicle may be limited.
29.7 The support vehicle shall not ordinarily transport participants except where:
a. A medical emergency arises;
b. Safety requires transportation;
c. A motorcycle becomes temporarily inoperable;
d. Operational circumstances reasonably require such transportation.
29.8 The availability of a support vehicle does not guarantee uninterrupted mechanical recovery services throughout the expedition.

30. ROAD CAPTAIN
30.1 Every guided expedition shall ordinarily be supervised by one or more Road Captains appointed by Peregrine Odyssey.
30.2 The Road Captain is responsible for:
a. Leading the expedition;
b. Coordinating the riding group;
c. Managing daily schedules;
d. Providing route guidance;
e. Promoting safe riding practices;
f. Responding to operational issues;
g. Coordinating with local authorities where necessary.
30.3 Participants agree to follow reasonable instructions issued by the Road Captain throughout the expedition.
30.4 Instructions issued by the Road Captain relating to participant safety shall take precedence over individual riding preferences.
30.5 The Road Captain may temporarily stop the expedition whenever reasonably necessary due to:
a. Hazardous road conditions;
b. Weather;
c. Mechanical issues;
d. Medical emergencies;
e. Traffic conditions;
f. Safety concerns.
30.6 Persistent refusal to comply with reasonable safety instructions may result in removal from the expedition without entitlement to compensation, subject to applicable law.

31. FUEL
31.1 Unless expressly stated within the expedition description, fuel costs are not included within the expedition price.
31.2 Participants remain responsible for ensuring that their motorcycle maintains sufficient fuel for each stage of the expedition.

31.4 Peregrine Odyssey shall not be responsible for delays arising solely from a participant's failure to maintain an adequate fuel level.
31.5 Participants acknowledge that fuel availability in remote mountainous regions may be affected by:
a. Weather;
b. Road closures;
c. Transportation disruptions;
d. Local shortages;
e. Government restrictions.

32. LUGGAGE
32.1 Participants shall travel with luggage suitable for motorcycle expeditions.
32.2 Peregrine Odyssey may specify luggage limits before the commencement of an expedition.
32.3 Participants are responsible for ensuring that luggage is appropriately secured during transportation.
32.4 Peregrine Odyssey recommends that participants avoid carrying unnecessary valuables.
32.5 Participants remain solely responsible for:
a. Personal documents;
b. Cameras;
c. Mobile phones;
d. Laptops;
e. Jewellery;
f. Cash;
g. Other personal valuables.
32.6 Where luggage is transported within a support vehicle, Peregrine Odyssey shall exercise reasonable care but shall not be responsible for ordinary wear and tear, minor cosmetic damage, or loss arising from circumstances beyond its reasonable control.
32.7 Participants should immediately report any missing luggage to expedition staff.

33. RIDING FORMATION
33.1 For the safety of all participants, Peregrine Odyssey may require riders to travel in a designated riding formation.
33.2 Participants shall maintain reasonable following distances appropriate to prevailing road, traffic, and weather conditions.
33.3 Participants shall not overtake the Road Captain or designated lead rider unless expressly instructed.
33.4 Dangerous riding practices, including excessive speeding, reckless overtaking, racing, or deliberate endangerment of other road users, are strictly prohibited.
33.5 Participants shall operate motorcycles in accordance with all applicable traffic laws throughout the expedition.
33.6 Peregrine Odyssey reserves the right to issue safety warnings or remove participants from an expedition where their riding behaviour presents a material risk to themselves or others.

34. COMMUNICATION DURING EXPEDITIONS
34.1 Peregrine Odyssey may communicate expedition-related information through verbal briefings, messaging applications, telephone calls, radio equipment, or other appropriate communication methods.
34.2 Participants shall provide a valid mobile contact number prior to the expedition.
34.3 Participants should promptly inform expedition staff of:
a. Medical concerns;
b. Mechanical issues;
c. Delays;
d. Accidents;
e. Emergencies;
f. Circumstances affecting their continued participation.
34.4 Participants acknowledge that mobile network coverage may be unavailable in certain remote locations and that communication interruptions may occur beyond the reasonable control of Peregrine Odyssey.

35. LOCAL LAWS, CULTURAL RESPECT AND ENVIRONMENTAL RESPONSIBILITY
35.1 Participants shall comply with all applicable laws, regulations, permits, and lawful directions issued by governmental authorities during the expedition.
35.2 Participants shall conduct themselves respectfully toward local communities, customs, traditions, religious sites, and cultural practices.
35.3 Participants shall avoid behaviour that may reasonably be regarded as offensive, discriminatory, disruptive, or unlawful.
35.4 Participants shall make reasonable efforts to minimise their environmental impact by:
a. Avoiding littering;
b. Disposing of waste responsibly;
c. Respecting wildlife;
d. Remaining on designated routes where required;
e. Avoiding unnecessary environmental damage.
35.5 Participants acknowledge that Peregrine Odyssey promotes responsible and sustainable tourism and expects all participants to contribute positively to the destinations visited.
35.6 Serious or repeated violations of applicable laws or conduct that materially endangers the safety, reputation, or operations of Peregrine Odyssey may result in immediate removal from the expedition, without prejudice to any other rights or remedies available under these Terms or applicable law.
36. RIDER CONDUCT AND CODE OF BEHAVIOUR
36.1 Every participant is expected to conduct themselves in a manner that reflects courtesy, professionalism, responsibility, and respect towards fellow participants, expedition staff, local communities, accommodation providers, government authorities, and members of the public.
36.2 Participants acknowledge that motorcycle expeditions involve close coordination amongst all members of the group. Behaviour that jeopardises the safety, enjoyment, or well-being of others shall not be tolerated.
36.3 Throughout the expedition, participants shall:
a. Treat fellow participants with dignity and respect;
b. Cooperate with expedition staff and Road Captains;
c. Maintain punctuality for all scheduled departures, briefings, meals, and activities;
d. Respect local customs, religious beliefs, traditions, and cultural practices;
e. Exercise good judgment while riding and during all expedition-related activities.
36.4 Participants shall refrain from:
a. Abusive or threatening behaviour;
b. Physical violence;
c. Harassment;
d. Discrimination based on race, religion, ethnicity, nationality, disability, gender, or any other protected characteristic;
e. Intimidation of other participants;
f. Damage to public or private property;
g. Conduct likely to bring Peregrine Odyssey into disrepute.
36.5 Persistent disruptive behaviour may result in disciplinary action, including removal from the expedition without entitlement to compensation, subject to applicable law.

37. MANDATORY RIDING GEAR
37.1 Participant safety is a fundamental priority of Peregrine Odyssey.
37.2 Every rider shall wear an approved protective helmet meeting applicable legal standards while operating a motorcycle during the expedition.
37.3 Peregrine Odyssey strongly recommends the use of the following protective riding equipment throughout the expedition:
a. Riding jacket with protective armour;
b. Riding trousers or equivalent protective apparel;
c. Riding gloves;
d. Riding boots providing adequate ankle protection;
e. Knee protection;
f. Elbow protection;
g. Rain gear suitable for mountainous environments;
h. High-visibility apparel where appropriate.
37.4 Participants acknowledge that failure to wear appropriate riding gear significantly increases the risk of serious injury.
37.5 Peregrine Odyssey reserves the right to refuse participation where a rider appears inadequately equipped for the planned expedition.
37.6 Participants remain solely responsible for ensuring that all personal riding equipment is:
a. Properly fitted;
b. Well maintained;
c. Appropriate for prevailing weather conditions;
d. Suitable for the terrain to be encountered.

38. ALCOHOL, DRUGS AND INTOXICATION
38.1 Participant safety requires that motorcycles be operated only by individuals who are fully alert and capable of exercising sound judgment.
38.2 Participants shall not operate a motorcycle while:
a. Under the influence of alcohol;
b. Under the influence of narcotic substances;
c. Under the influence of illegal drugs;
d. Impaired by medication affecting riding ability.
38.3 Consumption of alcohol shall not excuse any breach of these Terms.
38.4 Peregrine Odyssey reserves the right to prohibit any participant from riding where there are reasonable grounds to believe that the participant's ability to ride safely is impaired.
38.5 Where participant conduct presents an immediate safety risk, Peregrine Odyssey may remove that participant from the expedition without liability for any resulting losses, subject to applicable law.
38.6 Participants remain personally responsible for complying with all laws relating to alcohol, controlled substances, and driving.

39. MEDICAL FITNESS AND HEALTH DECLARATIONS
39.1 Motorcycle expeditions may involve prolonged riding, varying weather conditions, high-altitude environments, remote regions, and physically demanding activities.
39.2 Each participant is responsible for ensuring that they are medically fit to participate in the expedition.
39.3 Participants should disclose any medical condition that could reasonably affect their ability to participate safely where such disclosure is requested during the booking process or before departure.
39.4 Such conditions may include, without limitation:
a. Cardiovascular disorders;
b. Respiratory illnesses;
c. Epilepsy;
d. Severe allergies;
e. Diabetes requiring emergency intervention;
f. Mobility limitations;
g. Any condition requiring immediate medical attention during travel.
39.5 Participants remain responsible for carrying adequate personal medication throughout the expedition.
39.6 Peregrine Odyssey shall not be responsible for administering medication except for reasonable first-aid assistance where appropriate.
39.7 Participants are encouraged to consult their medical practitioner before undertaking any expedition involving significant altitude, remote travel, or prolonged motorcycle riding.

40. EMERGENCIES DURING THE EXPEDITION
40.1 In the event of an emergency, participants agree to follow all reasonable instructions issued by the Road Captain or authorised expedition personnel.

c. Mechanical failures creating immediate danger;
d. Natural disasters;
e. Security incidents;
f. Severe weather;
g. Road blockages;
h. Other unforeseen operational events.
40.3 Peregrine Odyssey shall make reasonable efforts to coordinate emergency assistance appropriate to the circumstances.
40.4 Participants acknowledge that expeditions may operate in remote regions where emergency medical services, communication networks, recovery vehicles, or hospitals may not be immediately available.
40.5 Emergency decisions taken by the Road Captain shall be made in the interests of participant safety and operational practicality.

41. MECHANICAL BREAKDOWNS
41.1 Participants acknowledge that motorcycles are mechanical machines and may occasionally experience unforeseen failures.
41.2 Where a rented motorcycle develops a mechanical issue not caused by participant negligence, Peregrine Odyssey shall make reasonable efforts to coordinate repairs or arrange an appropriate replacement where operationally feasible.
41.3 Participants using privately owned motorcycles remain responsible for the maintenance and repair of those motorcycles unless otherwise expressly agreed.
41.4 Peregrine Odyssey does not guarantee immediate availability of replacement motorcycles or spare parts, particularly in remote regions.
41.5 Temporary delays arising from mechanical repairs shall not ordinarily constitute a breach of these Terms.

42. PHOTOGRAPHY, VIDEOGRAPHY AND DRONES DURING EXPEDITIONS
42.1 Participants are welcome to take photographs and videos for personal, non-commercial purposes, provided such activities do not compromise safety, privacy, or applicable law.
42.2 Participants operating cameras, action cameras, drones, or similar equipment remain solely responsible for complying with all applicable laws, regulations, permit requirements, and restrictions.
42.3 Drone operations may be prohibited or restricted in certain areas, including near airports, military establishments, protected areas, or locations designated by governmental authorities.
42.4 Participants shall obtain any permissions required by law before operating drone equipment.
42.5 Peregrine Odyssey shall not be responsible for the confiscation, loss, damage, or legal consequences arising from the unlawful use of drones or other recording equipment.

43. WILDLIFE, PROTECTED AREAS AND RESTRICTED ZONES
43.1 Participants shall comply with all laws governing national parks, wildlife sanctuaries, protected forests, environmentally sensitive areas, and other protected locations visited during an expedition.
43.2 Participants shall not disturb wildlife, damage vegetation, remove natural objects, feed wild animals, or engage in activities prohibited by applicable law.
43.3 Where permits are required for entry into restricted areas, participants shall cooperate in providing any information reasonably necessary to obtain such permits.
43.4 Access to certain destinations may be denied or restricted by governmental authorities at any time. Peregrine Odyssey shall not be liable where such restrictions require modification of the expedition itinerary.
43.5 Participants shall respect all instructions issued by forest officials, military personnel, local authorities, or other competent governmental agencies.
44. ACCOMMODATION CONDUCT
44.1 Participants shall conduct themselves responsibly while staying at any hotel, guest house, homestay, campsite, resort, lodge, or other accommodation arranged as part of an expedition.
44.2 Participants shall comply with all reasonable house rules established by the accommodation provider, including rules relating to check-in, check-out, noise levels, smoking, alcohol consumption, use of facilities, safety, and security.
44.3 Participants shall respect the privacy, comfort, and peaceful enjoyment of other guests staying at the accommodation.
44.4 Unless expressly included in the expedition package, incidental expenses incurred at the accommodation, including but not limited to room service, minibar purchases, laundry services, telephone charges, recreational facilities, spa services, or other optional amenities, shall remain the sole responsibility of the participant.
44.5 Participants shall remain financially responsible for any loss, damage, or excessive cleaning costs caused by their negligent, reckless, or intentional acts at the accommodation.
44.6 Peregrine Odyssey shall not be responsible for disputes arising directly between participants and accommodation providers concerning personal conduct, damage, or incidental charges.
44.7 Accommodation providers reserve the right to deny services or remove any guest whose conduct materially breaches their policies or applicable law.

45. RESPONSIBLE TOURISM AND ENVIRONMENTAL COMMITMENT
45.1 Peregrine Odyssey is committed to promoting responsible tourism and expects all participants to contribute positively to the preservation of the natural environment, local communities, and cultural heritage.
45.2 Participants shall make reasonable efforts to minimise their environmental impact throughout the expedition.
45.3 Participants agree to:
a. Avoid littering;
b. Use designated waste disposal facilities;
c. Minimise unnecessary plastic waste where practicable;
d. Respect wildlife and natural habitats;
e. Avoid damaging vegetation or natural formations;
f. Follow instructions applicable to protected ecological areas.
45.4 Participants shall respect local customs, languages, traditions, religious sites, monuments, and places of cultural significance.
45.5 Collection of plants, wildlife, rocks, archaeological artefacts, or culturally significant objects from expedition destinations is strictly prohibited unless expressly authorised by the competent governmental authority.
45.6 Peregrine Odyssey encourages participants to support local communities through respectful interaction and responsible purchasing from local businesses where appropriate.
45.7 Failure to comply with environmental or cultural protection requirements may result in removal from certain activities or, in serious cases, from the expedition.

46. PARTICIPANT REMOVAL FROM AN EXPEDITION
46.1 Peregrine Odyssey reserves the right to remove a participant from an expedition where continued participation would reasonably be expected to:
a. Endanger the participant;
b. Endanger other participants;
c. Endanger expedition staff;
d. Disrupt expedition operations;
e. Damage the reputation of Peregrine Odyssey;
f. Result in unlawful conduct.
46.2 Grounds for removal may include, without limitation:
a. Persistent refusal to follow reasonable safety instructions;
b. Dangerous riding behaviour;
c. Physical violence;
d. Harassment;
e. Threatening behaviour;
f. Serious intoxication;
g. Possession or use of illegal drugs;
h. Deliberate property damage;
i. Criminal conduct;
j. Repeated material breaches of these Terms.
46.3 Before removing a participant, Peregrine Odyssey shall, where reasonably practicable and having regard to safety and the circumstances, provide the participant with an opportunity to comply with the relevant instructions or cease the offending conduct.
46.4 Immediate removal without prior warning may occur where Peregrine Odyssey reasonably believes that immediate action is necessary to protect the safety or security of participants, staff, or the public.
46.5 A participant removed from an expedition shall remain responsible for:
a. Personal transportation;
b. Accommodation expenses incurred after removal;
c. Any additional travel costs;
d. Any liabilities arising from their own conduct.
46.6 Removal from an expedition shall not automatically entitle the participant to a refund. Any entitlement to a refund shall be determined in accordance with these Terms, the Cancellation & Refund Policy, applicable law, and the circumstances of the removal.

47. COMPLETION OF THE EXPEDITION
47.1 An expedition shall ordinarily conclude at the destination, date, and time specified in the confirmed itinerary, subject to reasonable operational modifications.
47.2 Upon completion of the expedition, Peregrine Odyssey's obligations under the booked expedition shall be deemed fulfilled, except for any obligations that expressly survive termination or completion under these Terms or applicable law.
47.3 Participants are responsible for arranging any onward travel, accommodation, or transportation required after the official conclusion of the expedition unless such arrangements form part of the booked package.
47.4 Any services requested by a participant after the official conclusion of the expedition shall be subject to separate availability, pricing, and agreement.

48. CUSTOMER FEEDBACK, REVIEWS AND COMPLAINTS
48.1 Peregrine Odyssey values constructive feedback and encourages participants to share their experiences following an expedition.
48.2 Participants may submit feedback through the Website, email, or other officially designated communication channels.
48.3 Peregrine Odyssey may invite participants to publish reviews regarding their expedition experience.
48.4 Participants agree that any review submitted shall:
a. Be truthful;
b. Reflect their genuine experience;
c. Not contain knowingly false, misleading, defamatory, abusive, or unlawful statements;
d. Respect the privacy of other participants and staff.
48.5 Peregrine Odyssey reserves the right to remove or decline to publish reviews that violate these Terms or applicable law.
48.6 Complaints relating to an expedition should, where reasonably practicable, be brought to the attention of the Road Captain or expedition staff during the expedition so that reasonable efforts may be made to address the issue promptly.
48.7 Where a complaint cannot be resolved during the expedition, participants may submit a written complaint to Peregrine Odyssey after the expedition concludes. The Company shall make reasonable efforts to review and respond to such complaints within a reasonable period.

49. POST-EXPEDITION RESPONSIBILITIES
49.1 Participants remain responsible for returning any equipment, documents, or property belonging to Peregrine Odyssey or its authorised partners that has been temporarily provided during the expedition.
49.2 Participants shall promptly settle any outstanding payments lawfully due in connection with the expedition.
49.3 Participants are encouraged to inform Peregrine Odyssey of any significant safety concerns or operational issues identified during the expedition to assist in improving future expeditions.
49.4 Any rights or obligations under these Terms that by their nature are intended to survive the completion or termination of an expedition—including, without limitation, provisions relating to intellectual property, limitation of liability, indemnity, governing law, dispute resolution, and privacy—shall continue in effect.

50. GENERAL PROVISIONS OF VOLUME II
50.1 The operational arrangements described in this Volume are intended to promote participant safety, expedition efficiency, and a positive travel experience.
50.2 Peregrine Odyssey reserves the right to issue additional operational guidelines before or during an expedition where reasonably necessary to address specific destinations, weather conditions, local regulations, or safety considerations.
50.3 Participants agree to comply with such reasonable operational guidelines provided they do not materially conflict with these Terms or applicable law.
50.4 Nothing in this Volume shall limit any statutory rights available to participants under applicable consumer protection laws.
50.5 This Volume shall be read together with all other Volumes of these Terms & Conditions and with all policies incorporated by reference.
SAFETY, LIABILITY, CANCELLATIONS & LEGAL RESPONSIBILITIES

51. ACKNOWLEDGEMENT OF ADVENTURE ACTIVITIES
51.1 Participants acknowledge that motorcycle expeditions are adventure-based travel experiences that inherently involve a higher degree of risk than conventional tourism.
51.2 By booking or participating in an expedition organised by Peregrine Odyssey, each participant expressly acknowledges and accepts that such expeditions may involve, among other things:
a. Long-distance motorcycle riding;
b. Mountainous terrain;
c. High-altitude environments;
d. Unpredictable weather conditions;
e. Narrow or unpaved roads;
f. Reduced medical accessibility;
g. Mechanical failures;
h. Wildlife encounters;
i. Remote locations with limited communication infrastructure;
j. Other inherent risks associated with adventure travel.
51.3 Participants understand that while Peregrine Odyssey adopts reasonable safety practices, no expedition can eliminate all risks associated with adventure travel.
51.4 Participation in any expedition is voluntary.

52. ASSUMPTION OF RISK
52.1 By participating in an expedition, each participant voluntarily assumes all ordinary and inherent risks associated with motorcycle touring and adventure travel that cannot reasonably be eliminated through the exercise of due care.

a. Slippery roads;
b. Gravel roads;
c. River crossings;
d. Landslides;
e. Rockfalls;
f. Falling trees;
g. Snow;
h. Fog;
i. Rain;
j. Flooding;
k. High winds;
l. Wildlife;
m. Mechanical breakdowns;
n. Road accidents involving third parties;
o. Delays caused by governmental authorities;
p. Limited emergency response in remote locations.
52.3 Participants acknowledge that physical injury, illness, property damage, financial loss, or, in exceptional circumstances, death may occur despite reasonable safety measures.
52.4 Nothing in this clause excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

53. SAFETY BRIEFINGS
53.1 Peregrine Odyssey may conduct safety briefings before and during an expedition.
53.2 Participants agree to attend mandatory safety briefings where reasonably required.

c. Communication procedures;
d. Weather advisories;
e. Local regulations;
f. Route-specific hazards;
g. Medical information.
53.4 Participants are expected to seek clarification where they do not understand any safety instruction.
53.5 Failure to attend or comply with mandatory safety briefings may result in restrictions on participation where reasonably necessary for safety.

54. TRAVEL INSURANCE
54.1 Peregrine Odyssey strongly recommends that every participant obtain comprehensive travel insurance appropriate for motorcycle adventure travel before the commencement of the expedition.
54.2 Appropriate insurance should, where available and suitable for the participant's circumstances, include coverage for:
a. Emergency medical expenses;
b. Hospitalisation;
c. Medical evacuation;
d. Personal accident;
e. Trip cancellation;
f. Trip interruption;
g. Personal baggage;
h. Loss of personal belongings;
i. Motorcycle-related risks where applicable;
j. Third-party liability where available.
54.3 International participants should ensure that their insurance remains valid within India for the entire duration of the expedition.
54.4 Peregrine Odyssey does not provide insurance unless expressly stated in writing as part of a particular expedition package.
54.5 Participants remain solely responsible for understanding the terms, exclusions, and limitations of their own insurance policies.

55. MEDICAL EMERGENCIES
55.1 Where a participant experiences a medical emergency during an expedition, Peregrine Odyssey shall make reasonable efforts to coordinate appropriate assistance based on the circumstances, available infrastructure, and accessibility of the location.
55.2 Participants acknowledge that remote expedition routes may involve delayed access to hospitals, ambulances, rescue services, or specialised medical care.
55.3 Peregrine Odyssey may arrange transportation to the nearest appropriate medical facility where reasonably practicable.
55.4 All medical expenses incurred by a participant shall remain the responsibility of that participant unless otherwise covered by insurance or required by applicable law.
55.5 Peregrine Odyssey shall not be responsible for medical decisions made by licensed healthcare professionals treating participants.

56. ACCIDENTS
56.1 Participants shall immediately notify the Road Captain or expedition staff following any accident occurring during the expedition.
56.2 Peregrine Odyssey shall make reasonable efforts to:
a. Secure the immediate safety of participants;

c. Notify emergency contacts where appropriate;
d. Cooperate with governmental authorities where legally required.
56.3 Participants shall cooperate with any reasonable investigation relating to an accident.
56.4 Peregrine Odyssey shall not be responsible for accidents caused by:
a. Reckless riding;
b. Violation of traffic laws;
c. Alcohol or drug impairment;
d. Mechanical defects in privately owned motorcycles;
e. Wilful misconduct;
f. Negligence of third parties.
56.5 Nothing in this clause limits liability that cannot lawfully be excluded.

57. FORCE MAJEURE
57.1 Peregrine Odyssey shall not be liable for failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control.

d. Floods;
e. Cyclones;
f. Severe snowfall;
g. Avalanches;
h. Epidemics;
i. Pandemics;
j. War;
k. Terrorist activities;
l. Civil unrest;
m. Government restrictions;
n. Border closures;
o. Curfews;
p. Road closures;
q. Fuel shortages;
r. Strikes;
s. Communication failures;
t. Power failures;
u. Any similar event beyond reasonable control.
57.3 During a Force Majeure Event, Peregrine Odyssey may, where reasonably necessary:
a. Modify the itinerary;
b. Delay the expedition;
c. Suspend operations;
d. Cancel the expedition;
e. Substitute accommodation or routes;
f. Take any reasonable operational measure necessary to protect participant safety.
57.4 Peregrine Odyssey shall make reasonable efforts to communicate significant operational changes to participants as soon as practicable.

58. CANCELLATION BY THE CUSTOMER
58.1 Customers may request cancellation of their booking in accordance with the Peregrine Odyssey Cancellation & Refund Policy.
58.2 Cancellation requests should be submitted through the official communication channels designated by Peregrine Odyssey.
58.3 The effective date of cancellation shall ordinarily be the date on which the cancellation request is received by Peregrine Odyssey.
58.4 Refund eligibility, where applicable, shall be determined solely in accordance with:
a. The Cancellation & Refund Policy;
b. Applicable law;
c. The circumstances giving rise to the cancellation.
58.5 Failure to appear for an expedition without prior cancellation ("No Show") may result in forfeiture of amounts paid, subject to applicable law and the Cancellation & Refund Policy.

59. CANCELLATION BY PEREGRINE ODYSSEY
59.1 Peregrine Odyssey reserves the right to cancel an expedition where reasonably necessary due to:
a. Force Majeure Events;

e. Security concerns;
f. Circumstances beyond reasonable operational control.
59.2 Where an expedition is cancelled by Peregrine Odyssey, participants shall be informed as soon as reasonably practicable.
59.3 Any refunds or alternative arrangements shall be handled in accordance with the applicable Booking Policy, Cancellation & Refund Policy, and relevant law.
60. REFUNDS
60.1 Refunds shall be governed by the Peregrine Odyssey Cancellation & Refund Policy, which forms an integral part of these Terms & Conditions.
60.2 Refunds shall not be automatic merely because a booking has been cancelled.
60.3 Any refund shall be subject to:
a. The reason for cancellation;
b. The timing of the cancellation;
c. Non-recoverable costs already incurred by Peregrine Odyssey;
d. Applicable laws and regulations;
e. The Company's published Cancellation & Refund Policy.
60.4 Refunds, where approved, shall ordinarily be processed using the same payment method used for the original booking, unless otherwise required by law or agreed between the parties.
60.5 Processing times may vary depending upon banks, payment gateways, financial institutions, and applicable regulatory requirements.
60.6 Peregrine Odyssey shall not be responsible for delays caused solely by banking institutions, card issuers, payment gateways, or other financial intermediaries.
60.7 No refund shall ordinarily be payable for any unused portion of an expedition voluntarily declined by a participant after the commencement of the expedition, unless otherwise required by applicable law or expressly stated in the Cancellation & Refund Policy.

61. PARTICIPANT WITHDRAWAL DURING AN EXPEDITION
61.1 A participant may voluntarily withdraw from an expedition at any time.
61.2 Where a participant elects to withdraw after the expedition has commenced, Peregrine Odyssey shall make reasonable efforts to assist with logistical coordination where practicable; however, all resulting expenses shall remain the responsibility of the participant unless otherwise expressly agreed.
61.3 Withdrawal from an expedition shall not ordinarily entitle the participant to any refund for services already provided or services that cannot reasonably be recovered.
61.4 Peregrine Odyssey shall not be responsible for accommodation, transportation, meals, or other expenses incurred by a participant following voluntary withdrawal from the expedition.
61.5 Participants who withdraw due to illness, injury, or other unforeseen circumstances are encouraged to consult their travel insurance provider regarding any available coverage.

62. LIMITATION OF LIABILITY
62.1 To the fullest extent permitted by applicable law, Peregrine Odyssey shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of the Website or participation in an expedition.

a. Personal negligence of a participant;
b. Failure to comply with applicable laws;
c. Failure to follow reasonable safety instructions;
d. Mechanical failure of privately owned motorcycles;
e. Acts or omissions of independent third-party service providers;
f. Government actions or restrictions;
g. Force Majeure Events;
h. Delays beyond the reasonable control of Peregrine Odyssey.
62.4 Peregrine Odyssey does not guarantee uninterrupted operation of the Website or the continuous availability of any expedition, destination, accommodation, or motorcycle model.
62.5 Participants acknowledge that adventure travel involves risks that cannot be entirely eliminated despite reasonable planning and operational care.
62.6 Where liability is established, Peregrine Odyssey's liability shall be limited to the maximum extent permitted under applicable law and these Terms.

63. INDEMNIFICATION
63.1 You agree to indemnify, defend, and hold harmless Peregrine Odyssey, its proprietors, directors, officers, employees, Road Captains, representatives, contractors, agents, affiliates, and authorised partners from and against any claims, demands, actions, liabilities, damages, losses, costs, expenses, or reasonable legal fees arising out of or relating to:
a. Your breach of these Terms;
b. Your negligent or unlawful conduct;
c. Your violation of any applicable law;
d. Damage caused by you to persons or property;
e. Misuse of the Website;
f. Your infringement of the rights of any third party.
63.2 The indemnity provided under this clause shall survive the completion, cancellation, or termination of the expedition or these Terms.

65.5 Peregrine Odyssey shall not be responsible for delays, restrictions, or cancellations arising from governmental decisions beyond its reasonable control.

66. COMPLIANCE WITH APPLICABLE LAWS

66.3 Nothing in these Terms authorises or permits any participant to engage in conduct that is unlawful under the laws of India or any other applicable jurisdiction.
66.4 Peregrine Odyssey reserves the right to cooperate with lawful investigations conducted by competent authorities where required by law.

67. CLAIMS PROCEDURE
67.1 If a participant believes that Peregrine Odyssey has failed to fulfil its contractual obligations, the participant should notify the Company as soon as reasonably practicable.
67.2 Wherever possible, operational concerns should first be raised with the Road Captain or expedition staff during the expedition to allow an opportunity for prompt resolution.
67.3 If a matter cannot be resolved during the expedition, the participant may submit a written claim to Peregrine Odyssey, including:
a. Booking reference;
b. Participant details;
c. Description of the issue;
d. Supporting documents or photographs, where available;
e. Any other relevant information.
67.4 Peregrine Odyssey shall acknowledge receipt of a written claim within a reasonable period and shall make reasonable efforts to investigate and respond appropriately.
67.5 Nothing in this clause prevents either party from exercising any legal rights available under applicable law.
68. INSURANCE COOPERATION
68.1 Where a participant maintains travel insurance, personal accident insurance, motorcycle insurance, or any other applicable insurance policy, the participant shall remain responsible for initiating and pursuing any claim directly with the relevant insurer.
68.2 Upon reasonable request, Peregrine Odyssey may provide documentation in its possession that is reasonably necessary to support an insurance claim, including booking confirmations, invoices, payment receipts, or incident reports, subject to applicable law and privacy obligations.
68.3 Peregrine Odyssey does not guarantee that any insurance claim will be approved by an insurer.
68.4 Participants acknowledge that the acceptance, rejection, settlement, or valuation of any insurance claim is solely within the authority of the relevant insurance provider.
68.5 Any fees charged by insurers, surveyors, legal representatives, or other third parties in connection with an insurance claim shall remain the responsibility of the participant unless otherwise agreed.

69. LOSS OF PERSONAL PROPERTY
69.1 Participants are solely responsible for the security and safekeeping of their personal belongings throughout the expedition.

e. Laptops;
f. Jewellery;
g. Watches;
h. Wallets;
i. Cash;
j. Travel documents;
k. Personal identification documents;
l. Electronic equipment.
69.3 Participants should exercise reasonable care in safeguarding their belongings at all times.
69.4 Peregrine Odyssey shall not be responsible for loss, theft, damage, or misplacement of personal belongings unless such loss results directly from the proven negligence of Peregrine Odyssey where liability cannot lawfully be excluded.
69.5 Participants should immediately report any loss or theft to:
a. The Road Captain;
b. Local law enforcement authorities where appropriate;
c. Their insurer where insurance coverage exists.

70. EVIDENCE PRESERVATION
70.1 Where an accident, injury, property damage, or other significant incident occurs during an expedition, participants should, where reasonably practicable and safe to do so:

d. Record names and contact details of witnesses where possible;

70.2 Nothing in this clause shall require a participant to place themselves or others at additional risk.

79.3 Participants who do not wish to appear in promotional materials may inform Peregrine Odyssey before the commencement of the expedition. Peregrine Odyssey will make reasonable efforts to respect such requests where practicable.
